Terms of Service – Pulscore2

Please review these Terms of Service ("Terms") carefully before using Pulscore2 ("the Service", "the Application", "we", "us", or "our"), operated by deiG (asc.hk).

By accessing or using Pulscore2, you agree to be bound by these Terms. If you disagree with any portion of these Terms, you must immediately discontinue your use of the Application.

Medical & Health Disclaimer (Important)

PULSCORE2 IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL DIAGNOSES, TREATMENT, OR CLINICAL ADVICE.

The calculations, cardio load scores, resting heart rate values, and charts provided by Pulscore2 are intended solely for general personal fitness awareness and informational purposes. They are based on mathematical cardio load models and wearable sensor estimates, which can vary in accuracy.

Never disregard professional medical advice or delay seeking medical attention because of information viewed on Pulscore2. Always consult a qualified physician or healthcare provider before initiating any new exercise regimen or if you experience chest pain, shortness of breath, dizziness, or irregular heartbeat.

1. Description of the Service

Pulscore2 connects with the Google Health API (and compatible wearable devices such as Fitbit and Google Pixel Watch) via Google OAuth 2.0 to retrieve intraday heart rate and resting heart rate data. The application computes rolling Cardio Load exercise scores, tracks progress streaks, and presents visual charts to assist users in monitoring their training volume.

2. Eligibility and User Accounts

You must be at least 13 years old (or the applicable age of majority in your jurisdiction) to use Pulscore2.
To access the Service, you must hold a valid Google account with authorized access to your wearable health metrics.
You are responsible for maintaining the confidentiality of your credentials and controlling access to your devices.

3. Privacy & Data Protection

Your privacy is fundamental to our service. Our collection, processing, and handling of health metrics are governed by our Privacy Policy.

Pulscore2 strictly adheres to the Google API Services User Data Policy, including the Limited Use requirements. We do not sell, rent, or monetize your health information, nor do we disclose it to third-party advertisers or data brokers.

4. Acceptable Use & Compliance with Google APIs Terms of Service

When utilizing Pulscore2, you agree that you will not:

Use the Service for any unlawful, fraudulent, or malicious purpose.
Violate the Google APIs Terms of Service in any way, including using Google APIs or services to generate, distribute, or facilitate AI-generated Non-Consensual Intimate Imagery (AI NCII) or any prohibited synthetic media.
Use Google user data to develop, train, or improve generalized Artificial Intelligence (AI) or Machine Learning (ML) models.
Attempt to reverse-engineer, decompile, or disrupt the operation of the Application or associated APIs.
Attempt to gain unauthorized access to other user accounts, servers, or networks.
Use automated scraping or scripts that generate unreasonable load on Google APIs or the hosting server.

5. Third-Party Services and Trademarks

Pulscore2 relies on third-party APIs provided by Google LLC. We are not responsible for downtime, data inaccuracies, or modifications to Google's API platforms.
Google, Google Health, Fitbit, and Pixel Watch are trademarks of Google LLC. Pulscore2 is an independent application and is not officially affiliated with, endorsed by, or sponsored by Google LLC.

6. Disclaimer of Warranties

PULSCORE2 IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY.

WE DO NOT GUARANTEE THAT THE SERVICE WILL BE COMPLETELY ERROR-FREE, SECURE, OR FREE FROM TRANSMISSION DELAYS CAUSED BY THIRD-PARTY SENSORS OR NETWORK CONNECTIONS.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER (deiG / asc.hk) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, LOSS OF HEALTH DATA, OR INTERRUPTION OF TRAINING, ARISING FROM OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE PULSCORE2.

8. Termination

You may terminate these Terms at any time by ceasing all use of Pulscore2 and revoking authorization in your Google Account Security settings. We reserve the right to suspend or terminate access to the Service at any time without notice for violation of these Terms.

9. Changes to These Terms

We reserve the right to update or modify these Terms as needed. Material changes will be reflected with an updated date at the top of this document. Your continued use of Pulscore2 following any changes constitutes acceptance of the new Terms.
